Terms of Service

The ground rules for using Clinched and entering ticket contracts.

These policies are written to be clear and practical. If a policy conflicts with a right you cannot waive under applicable law, that law controls.

1. Agreement to these terms

These Terms of Service form a binding agreement between you and Clinched when you access the platform, create an account, list inventory, buy a contract, or otherwise use our services. You must be at least 18 years old and able to enter a binding contract.

Our Buyer Agreement, Seller Agreement, Fees, Refunds & Disputes Policy, Prohibited Inventory Policy, Privacy Policy, and Stripe Connect Disclosures are incorporated into these Terms.

2. What Clinched provides

Clinched is a marketplace for event-ticket contracts whose fulfillment depends on a clearly identified sports outcome. We provide the marketplace technology and payment workflow; we are not the event organizer, venue, team, ticket issuer, or a sponsor of any of them.

A listing must identify the event, qualifying team or outcome, seat information, quantity, price, and settlement condition. The listing details shown at checkout become part of the contract between buyer and seller.

3. Accounts and acceptable use

  • Provide accurate, current information and keep your credentials secure.
  • Use only payment methods, payout accounts, tickets, and inventory you are authorized to use.
  • Do not evade fees, manipulate prices, interfere with the platform, scrape protected areas, or use Clinched for unlawful activity.
  • Notify support@clinched.com promptly of suspected account compromise or unauthorized activity.

4. Contracts, payments, and fulfillment

A purchase becomes binding when payment is confirmed. Funds may be held while fulfillment and settlement conditions are evaluated. Sellers must maintain control of listed inventory and complete delivery according to the listing and Seller Agreement.

Outcome data, event status, and delivery records may come from third parties. We may correct obvious errors, pause settlement, request evidence, or cancel a transaction when information is unreliable, an event changes materially, or fraud is suspected.

5. Suspension and termination

We may restrict, suspend, or terminate access; remove listings; hold payouts where legally permitted; or cancel transactions to protect users, comply with law, investigate fraud, enforce our policies, or address platform risk. You may stop using Clinched at any time, but existing obligations survive.

6. Disclaimers and limits

Clinched is provided on an “as is” and “as available” basis to the extent permitted by law. We do not guarantee that a team will qualify, an event will occur as scheduled, inventory will remain available, or the service will be uninterrupted.

To the fullest extent permitted by law, Clinched is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data. Our aggregate liability relating to a transaction will not exceed the greater of the fees you paid to Clinched for that transaction or $100. Some jurisdictions do not allow certain limitations, so these limits may not apply to you.

7. Changes and contact

We may update these Terms prospectively. Material changes will be posted with a new effective date and, when appropriate, additional notice. Continued use after an update means you accept the revised Terms.
